These Terms and Conditions ("Terms") govern your access to and use of EdukshaIQ (the "Platform"), operated by SASTAVA Growth System Private Limited ("SASTAVA", "we", "us"). By accessing or using the Platform, or by authorising your school's users to do so, you agree to these Terms. If you do not agree, do not use the Platform.

1. Definitions

Platform: the EdukshaIQ application, its assessments, reports, dashboards and related services.
School: the educational institution that subscribes to the Platform.
User: any person authorised by the School to access the Platform, including administrators, principals, coordinators, teachers and students.
School Data: data entered into or generated through the Platform in respect of the School and its students.

2. Eligibility and accounts

The Platform is intended for use by Schools and their authorised Users. Accounts are created for and on behalf of a School. You are responsible for keeping login credentials confidential and for all activity that occurs under your account. You must notify us promptly of any unauthorised use.

3. Licence to use

Subject to these Terms and to payment of applicable fees, SASTAVA grants the School a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its internal educational purposes during the subscription term. No other rights are granted.

4. Acceptable use

You agree not to, and not to permit any User to:

copy, modify, reverse engineer, decompile or attempt to extract the source code, models or underlying methods of the Platform;
resell, sublicense, rent or otherwise make the Platform available to any third party outside the School;
access the Platform to build a competing product or to benchmark it for a competitor;
upload unlawful, infringing or harmful content, or interfere with the security or integrity of the Platform;
use automated means to scrape or harvest data from the Platform.

5. School responsibilities

The School is responsible for obtaining all consents required from students and their parents or lawful guardians before providing student data, for the accuracy of the data it enters, and for ensuring that its Users use the Platform in accordance with these Terms and applicable law.

6. Intellectual property

The Platform, including its software, assessment models, content, design and all related intellectual property, is and remains the property of SASTAVA and its licensors. The School retains ownership of School Data. The School grants SASTAVA the right to process School Data as needed to provide and improve the Platform, as described in our Privacy Policy.

7. Fees and payment

Fees are as set out in the applicable order or subscription plan. Unless stated otherwise, fees are payable in advance and are exclusive of applicable taxes. All fees are non-refundable in accordance with our Refund Policy.

8. Nature of the service: guidance, not a guarantee

EdukshaIQ provides indicative, evidence-based guidance to support better-informed decisions. Assessment scores, readiness bands, projected ranges and career suggestions are indicative and advisory only. They reflect a student's current performance and are not a guarantee of any examination rank, score, admission, employment or career outcome. The Platform is not a substitute for professional counselling, or for medical, financial or legal advice. Decisions made by a School, student or parent based on the Platform are their own responsibility.

9. Service availability

We aim to keep the Platform available and reliable, but we do not warrant uninterrupted or error-free operation. We may carry out maintenance, updates and changes, and may modify or discontinue features.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by law, SASTAVA's total aggregate liability arising out of or relating to the Platform shall not exceed the fees paid by the School for the Platform in the twelve months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special or consequential losses, or for loss of opportunity, arising from use of the Platform.

11. Indemnity

The School agrees to indemnify and hold harmless SASTAVA against claims, losses and expenses arising from the School's breach of these Terms, its misuse of the Platform, or its failure to obtain the consents required for student data.

12. Suspension and termination

We may suspend or terminate access for non-payment, breach of these Terms, or where required by law. On termination, the licence to use the Platform ends. Provisions that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. The parties submit to the exclusive jurisdiction of the courts at Coimbatore, Tamil Nadu.
